Bond paragraph now included in the Order when the surviving spouse takes the entire estate (Testate)

When the petitioner is the decedent’s surviving spouse and receives the entire estate, the interview tells you bond is exempt under RCW 11.28.185 and skips the question about whether the Will waives bond. In that situation, the Order to Open Probate (testate) was leaving out the Bond paragraph entirely.

The Order now includes it in both places:

• In the findings: “Bond. No Bond is required by RCW 11.28.185 based on the facts in this matter.”
• In the order: “Bond. No Bond is required.”
  
  

Orders where the Will waives bond, or where you ask the Court to waive bond or set a bond amount, are unchanged.
