We have updated the Oregon Durable Power of Attorney. Thank you to the Oregon users who sent in comments.
- Standard for Agent. The indemnity sentence now protects the Agent "except acts or omissions not taken in good faith." Before, it read the other way around.
- Termination. The list of events that end the Agent's authority now reads "revocation by a court, including upon the appointment of a conservator of my estate if the court so orders." A dissolution now ends the Agent's authority only when it is "the filing of an action for dissolution or annulment of my marriage or registered domestic partnership to my Agent, or for our legal separation." This follows ORS 127.015.
- Financial Incapability. When the power of attorney is effective immediately, the definition no longer ends with the sentence explaining that financial incapability is a lower standard than incapacity. Powers that take effect on incapability keep that sentence.
- Effectiveness heading. When the spouse's authority is effective immediately and the other Agents act on financial incapability, that paragraph is now headed "Effectiveness."
- Trust and Estate Matters. "Joint property" now reads "property I hold jointly with another person."
- Digital Assets. Item (c) now uses the statutory term, "a catalog of electronic communications" (ORS 119.006(4)).
- Smaller corrections:
- a double space removed in the Digital Assets definition;
- in Retirement Benefits and Deferred Compensation, a missing quotation mark added and "includes" corrected to "include";
- a missing period added in the Successor Agent paragraph;
- a stray space before a comma removed in Obtain Access to Medical Records.
