How do I choose the right Oregon estate planning package?

To begin drafting an estate planning package, start by navigating to the Estate Planning Document Packages folder. This folder contains bundled drafting templates designed to generate a complete, coordinated Oregon estate plan within a single workflow.  


Estate Planning Document Packages are organized first by client relationship status. At the top level, the folder is divided into three subfolders:

  • Married Couple

  • Single Person

  • Unmarried Committed Couple


 

Each subfolder contains drafting packages tailored to the legal framework and planning considerations unique to that relationship structure under Oregon law.


Your first decision in any estate planning workflow is selecting the correct relationship-status subfolder. From there, you will choose the appropriate planning structure (trust-based or will-based, joint or separate, mirrored or individualized).


Married Couple Planning Packages

The Married Couple subfolder contains estate planning packages designed for spouses planning together, including coordinated fiduciary and dispositive planning.


Within this subfolder, users choose:

  • Whether the plan is trust-based or will-based, and

  • Whether documents are created jointly, mirrored, or separately.



Trust-Based Planning Packages

These packages are used when a revocable trust is the primary planning vehicle.

  • Joint Revocable Trust-Based Planning Package: Creates a single joint revocable trust for both spouses, along with separate supporting documents for each spouse, assembled at the same time.
  • Mirrored Joint Revocable Trust-Based Planning Package: Creates a single joint revocable trust with mirrored supporting documents for each spouse, assembled together for consistency and efficiency.
  • Separate Revocable Trust-Based Planning Package: Creates a separate revocable trust and supporting documents for each spouse, drafted one plan at a time rather than jointly.


All revocable trust packages also include pour over wills, financial powers of attorney, advanc directives, dispositions of remains instructions, personal health information authorizations, a funding deed, assignment of personal property, and a certification of trust. Document execution instructions and a narrative estate planning summary are also included if desired.


Will-Based Planning Packages

These packages are used when planning is centered on wills rather than revocable trusts.

  • Mirrored Will-Based Planning Package: 

Creates two mirror-image estate plans for spouses, drafted together to ensure consistency across documents.

  • Separate Will-Based Planning Package: 

Creates a distinct will-based plan for each spouse, drafted one at a time.


Will-based packages typically include wills, financial powers of attorney, advance directives, dispositions of remains instructions, and personal health information authorizations, all assembled as a coordinated set. Document execution instructions and a narrative estate planning summary are also included if desired. 



Single Person Planning Packages

The Single Person subfolder contains estate planning document packages designed for individuals who are not married and are not planning jointly with a partner.


These packages are intentionally limited to single-person planning and do not address planning for unmarried partners or committed couples. Planning scenarios involving an unmarried partner are handled separately in the Unmarried Committed Couple subfolder.



The Single Person subfolder includes two package options:

  • Revocable Trust-Based Planning Package: Creates a complete trust-centered estate plan for an individual, including a revocable living trust and coordinated supporting documents. As with other revocable trust packages, this package includes a funding deed to support initial trust funding.

  • Will-Based Package: Creates a coordinated will-centered estate plan for an individual, assembling all related documents together in a single drafting workflow.


Unmarried Committed Couple Planning Packages

The Unmarried Committed Couple subfolder contains estate planning document packages designed for two individuals in a committed relationship who are not legally married.


These packages recognize that unmarried partners do not receive the same default legal protections as spouses under state and federal laws and therefore require intentional, coordinated planning to address property ownership, fiduciary roles, and dispositive provisions.  Note that there is not a joint revocable trust package avilable for unmarried couples.


 

The Unmarried Committed Couple subfolder includes the following package options:

  • Separate Revocable Trust-Based Planning Package: Creates a separate revocable trust and supporting documents for each partner, drafted one plan at a time.

  • Separate Will-Based Planning Package: Creates a will-based plan for each partner, drafted one at a time.
    This option is commonly used when partners have different dispositive wishes, fiduciaries, or planning priorities.

  • Mirrored Will-Based Planning Package: Creates two mirror-image will-based estate plans, drafted together at the same time to ensure consistency across documents.
