Probate: Surviving Spouse Tab

This tab is used when the decedent was married at the time of death. The information entered here identifies the surviving spouse for heirship and notice purposes and ensures proper language in the Petition and related pleadings.


Even in a testate probate, the surviving spouse’s rights and notice status must be accurately reflected.


Purpose of This Tab

The Surviving Spouse Information tab:

  • Identifies the surviving spouse

  • Supports heir determination for notice purposes

  • Confirms contact information for service or delivery of notice

  • Captures capacity status

  • Identifies whether notices must be directed to a representative


This information works together with the Decedent Information and Children and Grandchildren tabs to determine who qualifies as an heir and who must receive statutory notice.


Identifying Information

Enter the surviving spouse’s legal name and contact information. This ensures consistency in the Petition and related documents and supports proper notice. If the surviving spouse lived at the same address as the decedent, you may indicate that the address is the same. Otherwise, enter the correct mailing address.


Capacity of the Surviving Spouse

You must indicate whether the surviving spouse has legal capacity.


This selection is important because it may affect:

  • Whether notice must be directed to a guardian or representative

  • Whether additional parties must be included in the probate proceeding

  • How the spouse is referenced in pleadings

If the spouse lacks capacity, ensure that the appropriate representative information is entered.


Representation for Notice Purposes

If the surviving spouse is represented by another person, entity, or law firm for purposes of receiving notices, indicate that here.


This ensures that:

  • Notices are directed to the proper recipient

  • Pleadings accurately reflect representation

  • Service requirements are properly addressed

If the spouse is not represented, notices will be drafted to the spouse directly.
