Overview of the Washington Probate Product

Washington Probate Forms & Questionnaires in Agile EP are organized into functional folders based on the stage and type of probate administration being performed. The structure reflects how probate work is actually handled in practice: client intake, engagement, court filings, administration, and non-probate alternatives.


Begin by navigating to the folder that corresponds to the task you are performing and selecting the appropriate template. Client data may be loaded into a template during or after drafting.


Washington probate content is divided into the following folders:



Client Facing Education

This folder contains educational materials intended to help personal representatives and family members understand the Washington probate process. These materials explain core concepts such as appointment of a personal representative, notice requirements, creditor claims, timelines, and basic administrative duties. 

  • General Fiduciary Duties: discusses the PR's duty to follow the terms of the will, act prudently, maintain loyalty and impartiality, identify and protect estate assets, properly delegate responsibilities, maintain accurate records, and provide required information to beneficiaries and agencies. 


These documents are informational and do not generate court pleadings. Once assembled, these handouts are branded with your firm and assigned attorney.



Engagement Letter

This folder contains probate engagement agreement templates defining the scope and terms of representation in Washington estate administration matters. 

  • The documents clarify that representation is limited to the Personal Representative in their fiduciary capacity, outline the scope of legal services provided (including probate proceedings, notice requirements, creditor claims, inventory preparation, tax coordination, and asset distribution), and identify services excluded from representation.
  • The templates also address billing structure and hourly rates, responsibility for costs and third-party professionals, and the protections and limitations of attorney-client privilege during the administration process.



Client Questionnaires

This folder contains structured intake forms used to gather essential information at the beginning of a probate matter. Currently, the information collected includes decedent data and family, heir and beneficiary information.  Additional questionnaires related to asset inventories and creditor details will be added to the prodcut. 



Deeds

This folder contains probate-related real property transfer documents used during estate administration. These templates reflect Washington recording requirements and are typically used to transfer title pursuant to court authority or under nonintervention powers. 


The deeds in this folder are include the types of deeds in our Washington Estate Planning, as well as the following probate-specific deeds:

  • PR Deed: a Personal Representative’s Deed used to transfer real property from a decedent’s estate during probate administration. The deed conveys title pursuant to the authority granted to the Personal Representative under the will, court order, or nonintervention powers, and with reduced warranties afforded PRs.
  • Deed Allocating Community Property: a deed used to formally allocate or confirm the characterization of real property as community property between spouses in connection with estate administration. This document clarifies ownership interests for title purposes and may be used to ensure accurate distribution or to preserve community property tax treatment. Individually Available Probate Forms

This folder contains standalone probate pleadings and administrative documents that may be used independently, depending on the procedural needs of the case. These forms support specific filings, notices, declarations, and orders required under Washington probate statutes.



Testate Probate Document Sets

This folder contains bundled templates designed for probate administration when the decedent died with a valid will. These document sets generate coordinated pleadings necessary to open and administer a testate estate under Washington law. Blank Pleadings

This folder contains formatted Washington probate pleading templates without automated substantive content. These documents provide proper captioning and formatting for customized motions, petitions, and orders.



Nonprobate Estate Administration Packages

This folder contains bundled templates designed for administering Washington estates without opening a formal probate. The packages support common nonprobate procedures and provide coordinated drafting tools to manage transfers, creditor issues, and successor rights.


The folder includes full sets of documents to prepare and implement:

  • Small Estate Affidavits, including required notice to other successors and approval forms where applicable

  • Nonprobate Notice to Creditors, along with related pleadings, publication materials, and documents for managing and resolving creditor claims

  • Documents related to administering property passing under a Community Property Agreement, including confirmatory and implementation forms


These packages are designed to provide a structured, compliant pathway for resolving estates that qualify for simplified or nonprobate administration under Washington law.
