July 28, 2025 Update - Boilerplate Updates to Wills and Revocable Trusts

For Washington Documents Only:

To account for the new Washington Uniform Custodial Trust Act (WUCTA), the savings language in the General Provisions boilerplate has been updated to allow for a Personal Representative or Trustee to distribute assets that would otherwise pass outright to an incapacitated adult to a custodial trustee for administration in a custodial trust under the WUCTA.


Example Language: 


For Washington and Oregon Documents:

A new boilerplate choice has been added to bolster an existing paragraph that allows for a Trustee of a testamentary trust to withhold distributions to a beneficiary in certain circumstances. The new language adds additional powers and guidelines specific to substance abuse, mental health disorders, and financial difficulty to the “Trustee Power To Withhold” paragraph in “Trust Administration” provisions. The purpose of these provisions is to give more guidance for a Trustee who is working with a beneficiary in difficult circumstances, including giving the Trustee the right to request, for example, drug and alcohol testing before a distribution can be made to the beneficiary.
